Lawsuit alleges false advertising for iPhone 3G

Apple’s television advertisements suggest that the new iPhone 3G is “twice as fast.” An Alabama woman contends that the claim is false advertising, and she’s filed suit against Apple.

Represented by Birmingham, Alabama-based Trimmier Law Firm, Jessica Alena Smith filed suit earlier this week in U.S. District Court in Alabama. The firm representing Smith is seeking class action status for the suit.

Apple introduces the iPhone 3G to television viewers as able to surf the Web, downloading e-mail attachments and access map information twice as quickly as the first-generation iPhone.

Smith’s attorney, speaking to ABCNews.com, said that Apple has “failed to deliver on this promise.”

Attorneys from Trimmier Law Firm did not return calls from Macworld seeking comment on the suit.

Earlier this week, Apple released the 2.0.2 software update for the iPhone. An Apple spokeswoman said on Wednesday that the update was intended to improve communications with 3G networks.

Apple does not comment on pending litigation, but this isn’t the first time it’s come under legal scrutiny for the iPhone. In 2007 the company was sued for allowing the iPhone to be locked to AT&T’s network. Earlier that year the company was repeatedly sued over the iPhone’s sealed design, which prevents users from changing batteries.
