SimpleTech Inc., a manufacturer of flash-based data storage, has filed suit in California Superior Court against Lexar Media Inc., designer, marketer and licenser of removable flash-based digital media and card reader products.

According to the court files, “Trade libel, libel per se, interference with business opportunities, violation of the California Unfair Competition Act, and violation of the California Unfair Trade Practices Act” are listed in the complaint.
“This suit has been filed in response to our findings that Lexar Media, in order to gain a bigger share of the pertinent market, has been making malicious and false accusations against SimpleTech to our customers,” said Houman Fakhimi, general counsel to SimpleTech, in announcing the lawsuit. “We are taking this action now after several failed attempts to get Lexar Media to retract the statements they made to our customers. SimpleTech values the relationships it has with its customers and will vigorously prosecute this lawsuit to insure that our customers are not misled by the Lexar accusations.”
SimpleTech is seeking treble and punitive damages in the suit. In a separate action, look for the company to file a complaint with the Federal Trade Commission, urging them to investigate Lexar Media’s “unfair trade practices.”
